Article 1: Scope of application

The purpose of these general terms and conditions of sale is to govern all relations between Pierre et Christian Dumas SA, registered with the Paris Trade and Companies Registry under the number 778 115 246, having its registered office at 4 Cité de l’Ameublement, 75011 Paris, Party of the first part,

and

all individuals who are not professional buyers (private individuals) wishing to purchase directly online from our www.dumas-paris.com website or via the store section on www.dumas-literie.com, hereinafter referred to as the “Customer”, Party of the second part.

This document specifies the terms and conditions for orders, payment, deliveries and management of any returns of products ordered by Customers on the www.dumas-paris.com website. 

It may be consulted at any time on the www.dumas-paris.com website.

These general terms and conditions may be subject to subsequent changes, with the version applying to the Customer’s purchase being that in force on the website when the order is placed.

Article 2: Product orders

All orders placed on the www.dumas-paris.com website represent the formation of a contract concluded remotely between the Customer and the Dumas Literie online website, and necessarily involve the Customer’s irrevocable acceptance, unrestrictedly and unreservedly, of the general terms and conditions of sale before validating his/her order.

In order to enable the Customer to familiarise him/herself with the products which he/she wishes to purchase before ordering them, the www.dumas-paris.com website presents the features of the products offered for sale online. In particular, the www.dumas-paris.com website provides the specifications, illustrations and technical information concerning the products.

The Customer shall be able to call the customer service department of the e-Dumas online store on 0800 880 525 for all requests for advice.

The Customer is solely and uniquely responsible for choosing and purchasing products.

The Dumas Literie store offers the Customer the possibility of purchasing tailor-made products.

For all requests for tailor-made products, the Customer shall send a message to the e-Dumas store which shall process the special request as soon as reasonably possible.

The purpose of the photographs and graphics presented on the www.dumas-paris.com website is to illustrate the products offered for sale and they are non-contractual. The Customer is requested to refer to the description of each product in order to familiarise him/herself with the properties and specificities, in particular, as regards the required features and size.

The products are offered within the limit of available stocks. Information on product availability is provided in real time.

The sale shall be considered as final after collection of the full price by the e-Dumas online store.

Article 3: Prices and terms of payment

Prices are expressed in euros in the www.dumas-paris.com store and are understood as being inclusive of taxes (inclusive of all taxes, including VAT at the rate applicable on the order date).

These prices take account of any reductions which may be granted by the e-Dumas online store.

Prices are always understood as being exclusive of delivery expenses. The Customer is informed of the amount of delivery expenses when placing the order.

The products offered for sale are invoiced on the basis of the prices in force when the order is validated by the Customer. The price shown when the order is placed and the confirmation by the e-Dumas online store is the final price. Product offers are valid whilst they are visible on the website, within the limit of available stocks.  

The e-Dumas store reserves the right to change the prices at any time.

When placing their orders, Customers are requested to ensure that the price of the products to which they refer actually corresponds to the price appearing on the updated page of the www.dumas-paris.com website and not on an out-of-date page which they may have accessed via an Internet search in so-called “cache” mode.

The information provided by the Customer and recorded by the www.dumas-paris.com website store when the order is placed, represents proof of the transactions between the e-Dumas online store and the Customer. Once the Customer has validated the order, the e-Dumas online store shall send a confirmation e-mail to the Customer in order to inform him/her that the order has been duly recorded.

The price of the products purchased is payable in cash, in full on the date when the order is placed by the Customer. The e-Dumas online store shall not be bound to deliver products ordered by the Customer if it has not been paid the full price beforehand. Ownership is only transferred to the Customer after complete payment of the price by the latter. The transfer of the risks of loss and damage to the products shall take place upon receipt of the products by the Customer. 

The delivery expenses are specified on the www.dumas-paris.com website and are expressed inclusive of taxes (inclusive of all taxes). These expenses are assumed by the Customer and are invoiced in addition to the sale price of the products. Prior to the final recording of his/her order, the Customer shall be informed of the delivery expenses relating to his/her order and payment of the total amount of the purchase shall be requested from the Customer.

The orders passed by a customer living outside the Euro zone shall make his payment in Euro.

For Customers living outside the European Union, it is specified that the prices shown on the website shall be invoiced after deduction of VAT. These prices shall be understood as being DDU (Delivery Duty Unpaid), as it is physically impossible for e-Dumas to provide Customers with precise information on the total amount of expenses relating to customs duties and formalities and importation taxes applicable in the country to which delivery is requested.

Customers are solely responsible for payment of these expenses which may be required for the ordered products to be able to enter the delivery territory, and they accept this. 

Payment of the total price and delivery expenses is made by Carte Bleu, Visa, or Mastercard bank/credit cards, or by Paypal. The Customer must be the holder of the bank/credit card used. He/she accesses a dedicated space made available by a banking establishment, which is responsible for security and for recording the payment order.

The customer also has the possibility to use Paypal to pay for the purchase he made without enter his/her credit card number. He/she only needs his/her personal Paypal password and email address.

Payments by cheque are not accepted.

If, for any reason whatsoever (stop payment procedure, refusal by the issuer centre, etc…), it is impossible to debit the amounts owed by the Customer, the order shall not be recorded by Dumas.

 

Article 4: Delivery

The order shall be processed within an average timeframe of five business days following the date of the order.

With the exception of special circumstances or the unavailability of one or more products, the ordered products shall be delivered in a single delivery.

Deliveries are made by an independent carrier.

The Customer is bound to verify the condition of the delivered products upon receipt of his/her order.

Deliveries may not be made either to hotels or to post office boxes.
 

In France


Deliveries shall be made by DPD, with the Customer being able to have his/her parcel delivered to his/her home. Delivery delays are from 48 hours to 72hours.

For all deliveries outside these countries and especially for Russia, the shipping lead-times and expenses may vary according to the destination country. The customer shall send a request on Dumas custumer relationship: serviceclient@dumas-paris.com. The Dumas store shall provide you with the information as soon as reasonably possible. 

Article 5: Returns

Under Article L 121-20 of the French Consumer Code (code de la consommation), as modified by the Order no. 2014-344 of 17 March 2014, the e-Dumas store offers the possibility of returning one or more articles within fourteen days as from the day after receipt of the product, provided the product has not been used.

As the expenses and risks relating to returns are the responsibility of the Customer, products purchased from the e-Dumas store shall be returned by the service colissimo suivi (parcel service with tracking) offered by La Poste.

It is essential to follow the procedure set forth below for all RETURNS or EXCHANGES of products and to use the “e-Dumas returns form” which is inside your parcel.

The returns procedure is as follows:

-      Inform us by logging onto the website in the “my account”:

  1. Go in the section “History and details of my orders”
  2. Select the invoice corresponding to the products you want to return
  3. Select the products you want to return and confirm the quantity
  4. Kindly specify the reason for the return in the comments space if you want reimbursement or an exchange (quality, size, etc.). For exchanges, the reshipping expenses are paid by e-Dumas.
  5. Tick “Generate a return”
  6. When the status  of your demand is “ Waiting for package”, print out the return slip and put it in the return parcel together with the original invoice.
  7. Send the parcel by colissimo with the parcel tracking service within ten business days as from the date when the Return Number is allocated.

After receipt and verification of the conformity of the returned product (new product, unused, in its original packaging), we will reimburse you on the bank/credit card used for payment.

The Customer is informed that all returns shall be subject to e-Dumas’ prior agreement and that articles which are damaged, soiled, returned incomplete or without a Return Number are not able to be exchanged and/or reimbursed. Only the price of the returned article(s) shall be reimbursed.

In the case that the customer doesn’t want to keep an item delivered in conformity of its primary order, the return freight cost, the expedition freight cost and the custom cost or taxes or other would be at its charge.

All these cost shall be paid before e-dumas send a new reference item.

Tailor-made products or personnalised by an embroidery may not be returned and shall be neither exchanged nor reimbursed.

If the delivered products have a visible defect or are non-compliant, the Customer has one month as from delivery to make, by registered letter sent to Pierre et Christian Dumas SA, Service boutique en ligne e-Dumas, rue du Prè St Adrien, 89700 Tonnerre or by e-mail to the following address: serviceclient@dumas-paris.com, all reservations or claims for non-compliance or visible defects affecting the delivered products, with all relating supporting documents. 

Subsequent to this deadline, and should these formalities not have been complied with, the products shall be considered as compliant and without any visible defect and no claim may be validly accepted by the e-Dumas online store.

Obviously we will exchange the product (within the limit of available stocks), if we are responsible for its non-compliance. 

Article 6: Liability

The products offered comply with effective European legislation according to the Decree no. 2000/164 of 23 February 2000.

Pierre et Christian Dumas SA may not be held liable in the event of failure to comply with the legislation of a country outside the European Union where the products are delivered. The Customer is responsible for verifying the options in respect of importing or using the products which he/she is considering ordering with the local authorities.

Pierre et Christian Dumas SA may not be held liable for failure to perform the contract in the event of force majeure, flooding, fire and total or partial disruption or strikes, in particular, affecting transport and/or communication services.

Article 7: Data protection

The Customer is informed that the information relating to his/her order is subject to automatic data processing.

Under the Act no. 78-17 of 6 January 1978, it is hereby reiterated that the personal information requested from the Customer is required for processing his/her order and is destined for in-house use by the e-Dumas online store.

This personal information may be sent to partners of the e-Dumas online store in order to ensure the proper progress of the order (for example, to ensure secure payment or the proper progress of the delivery) and, in particular, to Pierre et Christian Dumas SA.

As regards the information concerning him/her, under the conditions provided for by effective legislation and regulations, the Customer has a right of access, modification and rectification in his/her “my account” space and a right of opposition by contacting the customer services department by telephone on 0800 880 525 or by e-mail at serviceclient@dumas-paris.com.

The purpose of this automatic data processing is to define a level of analysis for transactions and to combat bank/credit card fraud.

The existence of an unpaid amount owing to fraudulent use of a bank/credit card and incorrect or untruthful declarations by the Customer shall cause the information concerning the order relating to this unpaid amount to be recorded in a payment irregularity file managed for the e-Dumas online store.

Article 8: Governing law

These terms and conditions, and all the transactions carried out via the www.dumas-paris.com website, are governed by French law.

In the event of a dispute and in the absence of an out-of-court settlement between the Parties, only the French Courts shall have jurisdiction under the conditions of ordinary law.

Article 9: Intellectual property

All the elements of the www.dumas-paris.com website operated by the e-Dumas online store are and remain the exclusive property of the e-Dumas online store or of its supplier (owner), Pierre et Christian Dumas SA.

Under no circumstances is the Customer, or any other individual or legal entity, authorised to reproduce, benefit from, or use the elements of the aforementioned website, in any respect whatsoever, even partially.

The corporate names, trademarks and distinctive signs of the products on the www.dumas-paris.com website are protected under trademark law; the reproduction or representation of all or part of these elements is strictly forbidden.
